Picture a hillside lot in unincorporated Upper Ojai. A grading contractor cuts a flat pad into the slope behind the house for a detached ADU. Fourteen dump truck loads later, the math works out to roughly 70 cubic yards of cut. Ventura County's own grading exemption tops out at 50. The pad is already there. The permit isn't.
That's the most common way a hillside remodel, addition, or ADU turns into a stop-work conversation instead of a routine job. Homeowners budget for the building permit. Almost nobody budgets for the fact that moving the dirt underneath it can require an entirely separate permit, with its own engineer and sometimes its own public hearing. Quick Answer
In unincorporated Ventura County, a grading permit is required for any excavation or fill unless the work fits one of eleven exemptions in the Ventura County Building Code's Appendix J. The one most remodels and ADUs bump into is a 50-cubic-yard cap: an excavation under 2 feet deep, or a cut slope no taller than 5 feet at no steeper than 2:1, stays exempt only if it's 50 cubic yards or less. Fill has its own tiered caps between roughly 20 and 1,000 cubic yards depending on depth and slope. Cross any of those lines and you need a grading permit before a shovel goes in, separate from your building permit.
Past that point, the county splits work into two tracks. Under 500 cubic yards of cut or fill is "regular grading." Over 500 cubic yards is "engineered grading," designed by a licensed Civil Engineer, not a contractor's sketch. A handful of steeper, higher-volume projects fall into a third, discretionary track requiring an actual public hearing.
Simi Valley, Thousand Oaks, and the City of Ventura each run their own hillside ordinances on top of the county's rules; we're honest below about which numbers we could confirm.
When a Remodel or ADU Actually Triggers a Grading Permit
Passing your building plan check doesn't clear the grading question. They're two different permits under two different code sections.
Section J103.1 sets the default: no grading without a permit, except for the categories in Section J103.2. Three matter to most hillside homeowners:
Excavation tied to a building permit. If you're pulling a building permit for a foundation or footing, the excavation is exempt only if it's limited to the footprint plus 5 feet measured horizontally from any edge. Even inside that zone, the exemption doesn't cover fill made from that excavation if it exceeds 50 cubic yards placed at or below natural grade. Dig a foundation and pile the spoils back on the lot instead of hauling them off, and that pile has its own cap.
Small excavations. Section J103.2(8) exempts an excavation under 2 feet deep and 50 cubic yards or less, or one that doesn't create a cut slope steeper than 2:1 and stays under 5 feet of vertical cut and 50 cubic yards. A hillside pad cut for a garage-conversion ADU can clear the depth test and still fail the volume test, or the other way around. Both conditions have to hold.
Small fills. Section J103.2(9) tiers fill exemptions by depth: under 1 foot deep on a slope flatter than 20%, capped at 1 acre or 1,000 cubic yards; under 3 feet deep at its deepest point, capped at 50 cubic yards, not supporting a structure, on a slope no steeper than 2:1; or under 5 feet deep at its deepest point, capped at 20 cubic yards, same conditions. None apply if the fill obstructs a drainage course, regardless of volume.
Nothing here exempts a project because it's a "small addition" or "one ADU." The rule runs on cubic yards, depth, and slope, not building size. A modest 800-square-foot ADU on a steep lot can require more grading than a larger addition on a flat one.
One seasonal wrinkle: the county's grading permit conditions bar grading in the Coastal Zone between November 15 and April 15 outright, worth building into your schedule if your hillside lot sits near the coast.

Regular Grading, Engineered Grading, and the Discretionary Track
Once you need a permit, the county sorts your project into one of three tracks.
Regular grading covers under 500 cubic yards of combined cut or fill (Section J105.3.4), unless the Building Official flags special conditions that push it into engineered review regardless of volume. It still requires two sets of plans, a soils engineering report, and stormwater provisions.
Engineered grading kicks in automatically over 500 cubic yards (Section J105.3.5). A licensed Civil Engineer has to prepare, sign, and stamp the plans, and the submittal needs a hydrology and hydraulics report examining 10-year, 50-year, and 100-year storm frequencies, showing the site won't dump more runoff downstream post-development than it did before. That's a bigger scope than most homeowners picture when they hear "grading permit."
Discretionary grading is triggered by slope and volume together, and it's the track almost nobody expects. Under Section J103.3, a permit becomes discretionary, requiring CEQA review instead of a standard sign-off: average slope over 10% with more than 10,000 cubic yards moved; slope over 35% with more than 1,000 cubic yards; a graded slope taller than 40 vertical feet; grading flagged for a protected resource; or truck traffic exceeding 5 roundtrips per hour, peak-hour hauling, or a safety hazard at the site's access point. Land in that track and your project needs a public hearing, 10 days' written notice, a 15-day wait before the permit becomes operative, and a 10-day appeal window.
Most single-family remodels, additions, and ADUs never come near those numbers. A genuinely large hillside pad cut or a long driveway carved into a steep slope is where this shows up.
The Soils Report and Engineering Geology Piece
Grading review and geotechnical review aren't the same requirement, but they travel together on a hillside project. Section J105.4 requires a soils engineering report for a standard grading submittal, covering soil distribution and strength, grading recommendations, and an opinion on slope stability for the intended use. Where the site's geology warrants it, an engineering geology report gets added, complete with a geologic map and cross sections tied to the current grading plan. The Building Official can waive the report if the work doesn't call for one, and reports have to be dated within a year of the application unless approved otherwise.

Retaining Walls, Drainage, and the Setback Math Nobody Mentions
A hillside grading project rarely travels alone. It shows up bundled with a retaining wall, a drainage plan, or both, each carrying its own requirement layered on top of the grading permit.
Retaining walls need their own permit. The county's grading plan checklist states retaining walls, bridges, and exterior stairways connected to a structure, or within a path of exit, require a separate permit through Building and Safety, distinct from the grading permit covering the earthwork. Sand and gravel backfill behind a wall, within 1.5 times the wall's height, can qualify for its own grading exemption when approved. Slope setbacks follow a formula. Toe of slope to structure: half the slope's height, capped at 15 feet. Top of slope to foundation: one-third the height, capped at 40 feet. Toe of slope to property line: half the height, 2-foot minimum, 20-foot cap. Top of slope to property line: one-fifth the height, 3-foot minimum, 10-foot cap. A taller slope pushes your buildable footprint back from both the slope and the property line, shrinking a hillside lot's usable envelope more than a flat-lot setback ever would.
Drainage isn't optional. The county requires a paved interceptor drain along the top of any graded slope taller than 5 feet, plus terracing at set intervals on taller cut and fill slopes. Skip it, and that's what turns into erosion, slope failure, or a drainage complaint from a downhill neighbor a few wet winters later.
Protected trees add another layer. Grading within 50 feet of a protected tree's canopy, including trees on an adjacent parcel, requires documenting the tree's location and a tree permit or exemption letter from Planning before the grading permit issues. It's not a fee you lose; it's collateral the county holds until the work is inspected and finished, then releases. Timeline: What the Grading Question Adds to Your Schedule
Regular grading, once a complete application with plans and a soils report is in hand, generally moves on a timeline similar to other Ventura County structural permits, commonly 4 to 8 weeks, though Land Development Services should confirm current turnaround.
Engineered grading adds real time, mostly because the hydrology report, the civil engineer's stamped plans, and potential coordination with the Watershed Protection District for work near a mapped channel all have to be complete before the county signs off. Start that engineering scope early, not after your architect finalizes the building design.
Discretionary grading adds the hearing sequence above on top of everything else, easily several weeks before construction can start.
Caught during design, a missed grading question is a redraw. Caught mid-grading, it's a stop-work order, and the county can require correction of an excavation or fill that's already created a hazard, at the owner's expense. The 50-cubic-yard exemption exists because small jobs are common; it isn't designed to quietly cover the pad cut, driveway regrade, or ADU footprint most hillside homeowners actually plan.
Which Rulebook Applies to Your Address

Simi Valley, Thousand Oaks, and the City of Ventura are different. Simi Valley applies its own Hillside Performance Standards under Municipal Code Chapter 9-32 for parcels outside the Valley Floor; we confirmed the chapter exists but couldn't verify its specific thresholds at the primary source this session. Thousand Oaks layers a Hillside Planned Development overlay and a Protected Ridgeline Overlay Zone on its base grading rules, covering the terrain around Newbury Park and the ridgelines that give the city its name; we found the overlays referenced but couldn't verify their grading thresholds directly.
